WHISTLEBLOWING

Nova Tek S.r.l. gives its employees, partners, suppliers and stakeholders in general (such as shareholders, and persons with administrative, management, control, supervisory or representative roles) the opportunity to report significant illegal conduct pursuant to Italian Legislative Decree 231/2001, offences that fall within the scope of application of European Union or national acts relating to the sectors identified by Legislative Decree 24/2023 or violations of company procedures, through a dedicated platform that guarantees the confidentiality of the identity of the whistleblower.

The aim of adopting this tool is to prevent any non-compliance or irregularities within the organisation, but also to involve all stakeholders, and the public in general, in the fight against illegality, through active and responsible participation.

REPORTING

Reports are received by a Sole Manager, who undertakes to handle them confidentially and not to reveal the identity of the reporter, without his/her consent, in accordance with current regulations. Any personal data present is processed in compliance with current privacy regulations.

WHY REPORTING

Employees or other individuals are in a position to know about non-conformities or irregularities that the company is unable to identify in a timely manner. It is therefore important that companies have the opportunity to verify and possibly correct these anomalies. Responsible reports, made in good faith and in the interest of the common good, can allow the company to timely intercept, remedy and prevent illegitimate behaviour and irregular actions of corruption, fraud or other non-conformities that result in damage to the company and any third parties.

PROTECTION AND RESPONSIBILITY OF THE PERSONS INVOLVED

The report must be made in good faith, with supporting evidence and in detail. In any case, the information will be treated confidentially. Furthermore, the person making the report in good faith is protected from possible retaliation, as per current legislation.

During the verification and investigation of possible non-compliance, the individuals who are the subject of the reports may be involved or notified of this activity, but under no circumstances will proceedings be initiated solely because of the report in the absence of concrete evidence regarding its content.

It is the responsibility of the reporter to make reports in good faith and in line with the stated spirit of this procedure. Any reports manifestly unfounded, opportunistic and/or made for the sole purpose of harming the reported person or persons affected by the report, will not be taken into account and will be subject to disciplinary sanctions and/or legal proceedings.
